Refuge Association’s Covenants, Conditions, & Restrictions (CC&R’s)
Dear Neighbors and fellow Property Owners,
The current Covenants, Conditions, & Restrictions, (CC&R’s), have been in place since 2008, and were amended in 2009 to turn over the management of the Association to an elected Board of Directors. The review and updating of the CC&R’s has been a high priority of the Board of Directors.
A Committee of resident owners was established to review the Refuge CC&R’s in March of 2019 and now referred to as the Governing Documents Committee.
The Committee was initially comprised of residents: Fran Delach (Chair and Board Member); Dianna Soltez (Board Member); Dale Coalmer (Board Member); Thomas Sanders, and Ben LaParne.
The current Committee consists of Peggy Delach (Chair and Board Member), Tina Nelson, and Thomas Sanders.
Thank you to all these Committee members, as each has dedicated enormous time and energy to update this important governing document. The Committee submitted a draft of the CC&R’s after having numerous meetings over many months to develop various recommended amendments, which were submitted to the Board of Directors. After the Board’s review the proposed revised CC&R’s with recommended changes were submitted to the POA’s attorney for review and recommendations.
As you may understand with many other things going on for the POA and with Covid-19 slowing things down considerably this process took much longer than expected. However, the recommended Revised CC&R’s are now presented to you for your review, consideration, and ultimately your acceptance or rejection.
All proposed changes are highlighted and the reasons behind the recommended changes are explained. The Table of Contents has not been updated to enable you to cross-reference with an existing copy of the CC&R’s. Most of the recommended changes are related to updating and removing obsolete language related to the original developer, Zenn/Declarant, related to their control over the POA, Rules and Regulations. The most significant change is related to Article 11, Section 11.1, regarding future changes to our CC&R rules which could be made by attaining a “Simple Majority” or 50% + 1 for future amendments. As our community becomes more “built-out” your Board felt this change was needed and beneficial to all community owners.
The proposed updated CC&R’s are attached for your early review and for discussion at the upcoming Annual Association meeting. Ultimately, it will be the Board of Directors recommendation that the community approve the Revised Covenants, Conditions, and Restrictions document. This is an important step in preserving and improving this fine community as we make progress toward a built-out neighborhood association and golf course community.
